Terms and Conditions
No Guarantee of Performance: No guarantee or warranty is provided. All reasonable efforts are taken to convey to the customer what to expect and how organic lawn care should be practiced. Temperature, drought, foot traffic, watering, mowing, shade, invasive species, and soil chemistry are just a few variables, which in combination dramatically affect lawn appearance and are beyond Child’s Play’s control; e.g. pre-emergent weed control is applied in spring; however, an unusually cool season could delay germination of crabgrass until pre-emergent control has worn off, which could result in crabgrass development in a scalped, poorly irrigated lawn.
Pre-Payments: To qualify for a 5% pre-payment discount payment must be received prior to the first treatment or service for which the payment is being made. Pre-pay services are not subject to fuel surcharges (see below).
Pay As You Go: Payment is due upon receipt of invoice for services and products; i.e. upon treatment, an invoice will be left that is due immediately. A 2% per month finance charge will be applied to balances older than 30 days with a minimum charge of $3.00. No new services will be performed while an amount is outstanding from a previous treatment. Pay as you go services are subject to fuel surcharges (see below). Balances aged beyond 90 days will be turned over to a collection agency and remaining services cancelled.
Fuel Surcharges: Gasoline costs are extremely volatile and unpredictable. If regular unleaded gasoline rises above $4.50 per gallon the morning of a scheduled service, as advertised at the BP station in Granger, IN, a fuel surcharge of $2.00 will be assessed over and above the cost of the original quote. This charge is not retroactive to services already performed.
Notification and Scheduling: Child's Play will make applications according to the timeline provided as closely as possible. Weather conditions play a large role in that process, and we reserve the right to apply sooner or later than scheduled if necessary. Customers requiring/desiring a specific day’s schedule must specify as much on the front of the contract under
Fences, Locked Gates, and Pets in the Yard: Notification calls are customarily made 24-48 hours in advance of a scheduled treatment to alert customers with locked fences, gates and outdoor pets we require access to the yard. If upon arrival access to the restricted area is blocked or pets are out, we will treat what we can. We will contact the customer to reschedule and attempt treatment 1 more time. If, on the return day, access is still impeded, no further attempt to treat will be made and customer will be responsible for 75% of the invoice amount.
Utility and Sprinkler Head Locates: In order to perform power rake and aeration services underground utilities and sprinkler heads must be identified. We will coordinate the utility locate if customer provides the subdivision name, lot number and township of residence. Sprinkler heads, if installed, must be marked prior to service. We will provide marking assistance for a $30.00 fee. Assistance is defined as customer activating the sprinklers and a Child’s Play employee flagging the heads. Scheduled arrival to perform aeration/power rake on an unmarked sprinkler system, or customer absence on a scheduled marking day, will incur a $30.00 arrival fee and services will be rescheduled. Child’s Play is not responsible for damage to heads that were not located due to line pressure failure, operator inability to run the system, inactive / defective status of controller / solenoid, or any other defective element in the system.
Reasonable Time to Dispute: If a customer wishes to dispute / question the thoroughness, efficacy, or timeliness of an application the objection must be raised within a timeframe Child’s Play can reasonably be expected to resolve the concern; e.g. if customer believe a treatment was not done properly, they should not let the account age 60 days, then dispute paying the invoice. Let us know immediately so we can verify records, interview employees, inspect the lawn, etc.
Disputed invoices will not be credited / refunded if Child’s Play cannot take reasonable corrective measures to resolve the issue due to weather, seasonality of problem, or other issues related to lapsed time of complaint. For purposes of this condition the reasonable timeframe for lodging a complaint shall be within 7 working days of the performed service.
Refunds and Cancellations: Upon cancellation of contract or services, no refunds for products or services will be provided after July 1st of the calendar year. Credit for future services and/or products will be issued in lieu of a refund.
Yard Size and Variance: Every effort is made to accurately measure yards at the time of quoting. Customer may request a remeasure and price adjustment if landscaping, etc. is performed that significantly reduces the treatable area. Child's Play may remeasure and adjust pricing if it is determined that the treatable area is significantly different than what our records indicate. Child's Play will notify customer in advance of any increase in service pricing due to change in documented yard size.
Binding Contract: Customer signature constitutes a contract for services from Child's Play and agreement to these terms and conditions. Services will be performed once a signed contract is received. Verbal confirmation of acceptance, e.g. phone arrangement, shall be noted as “verbal per phone.” Signature on contract constitutes permission for Child's Play employees to enter property to perform services in absence of customer.
